JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,323,325 and 379 of the Indian Penal Code.
The accusation is of making assault to the informant and his family members.
It is submitted by the learned counsel for the petitioner that injury has been found to be simple. Statement to that effect has been made in paragraph 9 of the petition which reads as follows:
"That even as per allegation levelled in the FIR, the petitioner assaulted the informant on his right hand but injury found on the person of the informant is simple in nature."
Patna High Court Cr.Misc. No.31735 of 2015 (2) dt.05-08-2015 2/2 It is further submitted that the case lodged by the petitioner side is earlier in point of time. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gaya in connection with Paraiya P.S. Case No.126 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
