The present writ application has been filed for issuance of a writ of certiorari for quashing the order passed by Child Development Project Officer, Basopatti whereby private respondent has been appointed as Anganwadi Sewika for Anganwadi Sewika Centre No. 55 , Turha Tola, Purwari village situated in Panchayat Raj Arghawa within Basopatti P.S. in the District Madhubani.
Patna High Court CWJC No.16788 of 2014(2) dt.12-07-2021 2/2 Learned counsel for the petitioner at the very outset submits that petitioner seeks permission to withdraw this application with liberty to prefer appeal before the appellate authority i.e. District Magistrate, Madhubani. Learned counsel for the State has got no objection. In view of the submission as aforesaid, this writ application is permitted to be withdrawn with liberty to the petitioner to prefer appeal before the appellate authority i.e. District Magistrate Madhubani within a period of one month from today.
It is made clear that if appeal is filed within 30 days from today along with petition for condonation of delay, the appellate authority shall consider the same in accordance with law.
