The petitioner seeks bail in Pakribarawan (Dhamoul) P.S. case No. 208 of 2015 under Section 304B/34 of the Indian Penal Code.
The learned counsel for the petitioner submits that petitioner is father-in-law of the deceased. The husband of deceased is in jail. The petitioner being father-in-law of the deceased is in jail since 29.08.2016. Till date the trial has not yet been concluded but it appears that vide order dated 16.02.2017 the trial court was directed to proceed with the trial on day to day basis. The learned trial court vide its report dated 17.05.2017 has reported that six prosecution witnesses have already been examined. It appears that the trial is at its fag end.
Patna High Court Cr.Misc. No.52053 of 2016 (6) dt.19-06-2017 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The trial court is directed to conclude the trial holding the same on day to day basis and conclude the same within three months from the date of receipt of the order. If the trial is not concluded within three months, the petitioner may renew his prayer for bail.
