Petitioners apprehend arrest in a case registered for the offence punishable under Section 379 and other allied sections of the Indian Penal Code and section 30a of the Bihar Prohibition and Excise Act.

It is alleged that the people had caught one Pappu Chaudhary with five liters of wine and they were taking him to the police station. Meanwhile, petitioners by applying force got him released. They also entered into the house of one Chandradipi Prasad, a social activist, and abused him. They

Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. Petitioners have got no criminal antecedent. Allegations are general and omnibus and nothing specific has been attributed against the petitioners. Petitioners are no way concerned with the said co-accused.

Considering the facts of the case, let all the petitioners, above named, in the event of surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act Gaya in Barachatti Police Station Case No. 710 of 2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
