JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected vide orders dated 05.05.2016 and 19.04.2017 passed in Cr. Misc. Nos. 12451 of 2016 and 15108 of 2017, on the ground that the petitioner is in custody since 25.11.2015, other co-accused have been allowed bail, the wife of the petitioner committed suicide herself and her dead body was cremated in presence of the informant. Thereafter the informant lodged this false case. The trial has not been concluded within six months as per order given by this Court and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes prayer for bail of the

Patna High Court Cr.Misc. No.5973 of 2018 (6) dt.11-04-2018 2/2 petitioner by submitting that the petitioner is the husband and the trial is in progress.

In the facts and circumstances stated above, at present finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Sessions Trial No. 189 of 2016 arising out of Lakhisarai P.S. Case No. 427 of 2013 pending in the court of Sessions Judge, Lakhisarai.

However, let the trial be expedited and concluded as early as possible preferably within four months from the date of receipt/production of a copy of this order.
