JUSTICE MADHURESH PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 302, 120B and 34 IPC and section 27 Arms Act. Counsel for the petitioner submits that the petitioner's name has been roped in this case on confession of co-accused Pradeedp Tiwari who has also been allowed bail by this Court vide order dated 17.10.2017, passed in Cr.Misc.No. 45551 of 2017. Petitioner is in custody since 23.9.2017. Prior to the lodging of this case, he is accused in other case mentioned in paragraph 3 of the bail application, in which he is already on bail.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Hussainganj Police Station Case No. 166 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.
