Putting the allegation that on account of having evil eye over Priyanka Kumari, petitioner who once upon a time was a close friend of complainant Alok Kumar, developed differences and in the aforesaid background, petitioner by way of deception, succeeded in taking away the complainant to the place of Sandeep Kr. Singh where other co-accused were present since before and all of them brutally assaulted the complainant as a result of which he became unconscious. Thereafter, he was thrown near Das Ke Pokhar, wherefrom he was shifted to hospital. After having long treatment, lastly the complaint petition was filed after a long interval. From the successive orders which are annexed as Annexure 2 and 3 (Crl. Misc. no. 12975 of 2016 and Cr. Misc. no.
Patna High Court Cr.Misc. No.29386 of 2016 (2) dt.26-07-2016 2/2 6100 of 2016 respectively), it is evident that aforesaid bail petitions were disposed of after perusal of the case diary wherefrom it was traced out that at an initial stage, the complainant/ informant had disclosed that he sustained injury on account of falling from the motorcycle.
That being so, petitioner namely Guddu Kr. Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of like amount each to the satisfaction of Sub-Divisional Judicial Magistrate (W), Muzaffarpur in connection with Sahebganj P.S. case no. 189/2014.
