The petitioner apprehends arrest in a case registered for offence punishable under section 272 and other ancillary sections of the Indian Penal Code as well as section 30a of the Bihar Prohibition and Excise Act.

Police seized a truck carrying 3,457 liters of wine and arrested co-accused Awadesh Rai who disclosed the name of the petitioner as his accomplice, who managed to flee away to see the police.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner has got no criminal antecedent. Nothing incriminating has been recovered from his conscious possession and he has no concern with the seized wine. Similarly situated co-accused have already

Learned counsel for the State submits that the said truck was seized in front of a polutary firm which belongs to the petitioner.

In view of the allegation of huge quantity of recovery of wine from a truck which was parked in front of the poultry firm of the petitioner, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
