Mr. R.K.Raman, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-08-2025 Heard learned counsel for the petitioner, the State and opposite party no.2.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 318(4), 352 and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, petitioner took cash Rs. 4 lacs and six blank cheque from the informant/ opposite party no.2 on pretext of providing job, with assurance that amount would be returned either in cash or by executing land but later on petitioner refused to return the amount or to execute land.

4. By filing supplementary affidavit, It is submitted on behalf of the petitioner that the petitioner is ready to return outstanding amount of Rs.4 lacs to informant but in instalments.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on provisional bail on

No.26049 of 2025(4) dt.18-08-2025 2/2 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VII, Rohtas at Sasaram in Chenari Police Station Case No. 212 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure as well as on following conditions:- (i) At the time of filing bail bond, Rs. 1 lac shall be returned to informant and receipt to this effect shall be furnished in the Court below.

(ii) Rest amount of Rs. 3 lacs shall be returned to the informant by the petitioner in ten equal instalments within a year thereof.

(iii) If the petitioner complies with these conditions, court below shall itself confirm the provisional bail, otherwise appropriate order would be passed by it.
