This is a petition for grant of regular bail for offence under Sections 363 and 366A of the Indian Penal Code. The prosecution story, in brief, is that the informant's daughter went to Obra for coaching and did not return till evening. The informant started searching his daughter and came to know that the petitioner has kidnapped her, after alluring, for the purpose of marriage and the petitioner is also found out of his house.

Learned counsel for the petitioner submits that the petitioner is in custody since 05.05.2016. Charge sheet has been submitted in the case. There is no criminal antecedent against the petitioner and there is no allegation of tampering of the witness alleged against the petitioner. The victim has been examined under Section 164 of the Criminal Procedure Code. She has accepted the love affairs with the petitioner and she had left the house with her own consent. No physical abuse is alleged against the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Phesra P.S. Case No. 17 of 2016 to the satisfaction of the Additional Chief Judicial Magistrate, Aurangabad.
