KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 10-02-2021 The instant Letters Patent Appeal has been filed against the judgment dated 05.02.2019 passed by a learned Single Judge of this Court in C.W.J.C. No. 13844 of 2013, titled as Rakesh Singh Vs. The Union of India and Ors. It is not in dispute that on the date of issuance of the advertisement i.e. 28th of February, 2011, petitioner was not fulfilling the eligibility criteria. Certificate of income on which appellant sought reliance is dated 29th of November, 2011, undisputedly much after the submission of the application.
As such, we do not find any infirmity with the impugned judgment dated 05.02.2019 passed in C.W.J.C. No. 13844 of 2013 rejecting the appellant's claim. That apart, learned counsel for the State states that there is change in the policy that all advertisements issued stand cancelled vide communication dated 14th of January, 2016, issued by the Deputy Secretary, Government of India.
