JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 No one appears on behalf of the petitioner. Learned Additional Public Prosecutor for the State is present. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act. There is specific allegation against the petitioner that he along with one Kislay Kumar opened fire causing fire arm injury to one Vivek Kumar and Lovely Kumar @ Abhay Raj respectively and after that one Dharmendra Kumar was assaulted by other co-accused. All the injured were brought to hospital but Vivek Kumar and Lovely Kumar @ Abhay Raj succumbed to their injuries whereas another injured was referred to P.M.C.H.,

Patna High Court Cr.Misc. No.25810 of 2016 (2) dt.22-06-2016 2/2 Patna for treatment.

Regard being had to the facts and circumstances of the case as well as submission of the Additional Public Prosecutor, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Silao P.S. Case No. 180 of 2015 pending in the court of Judicial Magistrate 1st Class, Biharshariff, Nalanda stands rejected.
