17-11-2017 Heard Sri Ajay Kumar Singh, learned counsel for the petitioners and learned Addl. Public Prosecutor. Two petitioners, who are in custody since 27-08-2017 in Motihari Muffasil P.S. Case No. 445 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail.

Learned counsel for the petitioners, at the very outset by way of referring to statement made in paragraph - 3 of the petition, submits that both the petitioners are having clean antecedent, however; falsely in the present case, petitioners have been arrested on an accusation that both were accompanied on a

Patna High Court Cr.Misc. No.55422 of 2017(2) dt.17-11-2017 2/2 tempo, from which, recovery of huge quantity of Indian made foreign liquor was shown.

Considering the nature of accusation, clean antecedent as well as period of custody, let both petitioners namely Ramlal Thakur and Rakesh Mahto be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Motihari, East Champaran in connection with Motihari Muffasil P.S. Case No. 445 of 2017.
