The petitioner, who claims to be a person of clean antecedents and is in custody since 06.01.2020, seeks bail in connection with Simri P.S. Case No. 238 of 2019, dated 27.12.2019, instituted for the offence under Section 392 of the Indian Penal Code.

It appears that the F.I.R. has been registered against unknown. Three persons, viz., Arvind Rai, Ratnesh Kumar and Vijay Kumar Paswan were arrested, who gave their confession before the police regarding their involvement in the occurrence. It further appears that the

Patna High Court CR. MISC. No.16656 of 2020(2) dt.03-06-2020 2/2 looted vehicle was recovered from the possession of aforesaid Arvind Rai. From the house of the petitioner, 42 bags of looted maize seeds were recovered.

It has been urged on behalf of the petitioner that one Vijay Kumar Paswan had brought the maize seeds to the house of the petitioner. The petitioner claims to have kept the bags of maize seeds without any knowledge of the same having been looted commodity.

Regard being had to the period of custody of the petitioner and the nature of accusation, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Simri P.S. Case No. 238 of 2019.

The application stands allowed.
