JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-01-2018 This case has been taken up out of turn as the petitioner is an examinee of Intermediate examination which is scheduled from 11.01.2018. A supplementary affidavit to that effect has been filed today. Let it be kept on record. Heard the counsels for the parties.

The petitioner seeks bail in connection with Beur P.S. Case No. 33 of 2017 dated 30.01.2017 instituted for the offence under Section 379 of the Indian Penal Code. The F.I.R has been registered against unknown. The motorcycle of the informant is said to have been stolen away. It has been submitted on behalf of the petitioner that he was earlier made accused in two other cases and was arrested, first of all, in Jehanabad P.S. Case No. 58 of 2017 on

Patna High Court Cr.Misc. No.63355 of 2017 (2) dt.09-01-2018 2/2 01.02.2017 which was instituted for the offences under Sections 413, 414 of the Indian Penal Code. From the aforesaid case, he was remanded in Jakkanpur P.S. Case No. 26 of 2017 registered under Section 379 of the Indian Penal Code. In both the cases, the petitioner has been granted bail.

The petitioner is in custody since 24.07.2017. Regard being had to the aforesaid facts as well as that a co-accused with similar allegation has been granted bail by a Bench of this Court vide order dated 09.11.2017 passed in Cr. Misc. No. 52310 of 2017, this Court is inclined to grant bail to the petitioner also.

The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 8th, Patna in connection with Beur P.S.
