Petitioner apprehends his arrest in a case filed under Sections 147, 148, 149, 323, 427, 376, 511, 354, 308, 307 and 506 of the Indian Penal Code.
It is contended on behalf of the petitioner that he has been made an accused in a complaint case which was later referred to the police for investigation upon which F.I.R. has been lodged but no specific allegation has been made against him. It is further contended that the persons upon whom specific allegations have been made such as Sher Mohammad, Ziyaul Haque @ Md. Ziyaul Haque and others have been granted anticipatory bail by a
Patna High Court Cr.Misc. No.26145 of 2016 (2) dt.30-06-2016 2 / 2 co-ordinate Bench of this Court vide order dated 03.05.2016 passed in Criminal Miscellaneous No.18331 of 2016. Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Patahi P.S. Case No.176 of 2015, the above named petitioner, Md. Akhlaque @ Md. Akhlaque Ahamad shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of A.C.J.M. 8th Motihari, East Champaran subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
