====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 27-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner, who is in custody, seeks bail in connection with Muzaffarpur Nagar P.S. Case No. 17 of 2018 registered for the offences punishable under Sections 302, 34 and 120(b) of the Indian Penal Code and under Sections 27, 25(1-b)A, 26 and 35 of Arms Act.
Informant in his fardbeyan has alleged that on 10.01.2018 at about 8:30 P.M. while his shop was closed and two customers were inside the shop, two unidentified criminals entered the shop and fired upon Rohit Kumar who died and thereafter, both the criminals along with other criminals fled from the place of occurrence. FIR is against unknown, name of

No.49917 of 2018(2) dt.27-08-2018 2/2 the petitioner has surfaced in this case on the basis of confessional statement made by one Ranjeet Paswan and except this confessional statement there is no incriminating material against the petitioner and nothing has been recovered for the possession of the petitioner and similarly placed co-accused, namely, Vicky Kumar and Ranjeet Paswan have been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 33737 of 2018 and Cr. Misc. No. 39431 of 2018 vide order dated 23.07.2018 respectively.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Nagar P.S. Case No. 17 of 2018.
