The petitioner seeks bail in S.Tr.No.290 of 2017 arising out of Dhanarua P.S.Case No.149 of 2015 registered for the offences under Sections 302, 201, 120(B), 379/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner has been refused thrice, lastly on 02.08.2017 vide Cr.Misc. No.24461 of 2017 with direction to the trial court to conclude the trial of the petitioner within nine months by taking all effective steps. But the trial has not yet been concluded. Further submission is that the police got the statement of the petitioner recorded showing his involvement in the present
Patna High Court Cr.Misc. No.53117 of 2018 (2) dt.05-09-2018 2/2 case and he is in custody since 08.06.2015. Further submission is that co-accused Mantu Sharma from whose possession tempo was recovered has been extended the privilege of grant of bail vide order dated 19.04.2017 passed inCr.Misc.No.10719 of 2017 and co-accussed Shailesh Kumar whose name has come on the basis of confessional statement also has been granted bail vide order dated 27.03.2017 passed in Cr.Misc.No.4007 of 2017. Further submission is that the petitioner has no criminal antecedent. Having considered the facts and circumstances as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge, 9th Patna, in S.Tr.No.290 of 2017 arising out of Dhanarua P.S.
