2. The petitioner is in custody in connection with Samastipur P.S Case No. 236 of 2022 registered for the offences punishable under Sections 394 of the Indian Penal Code.

As per allegation in the FIR, the informant was returning to home after closing his Pan shop and he was carrying sale proceeds of Rs. 1,25,000/-, two unknown miscreants surrounded him and threatened him to handover the bag which contained the cash. The informant handed over the bag to them and they escaped on bike with third miscreant who was waiting for them. It is further alleged that informant was shot in the elbow due to indiscriminate firing by the miscreants.

4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner is named in FIR nor he has been put on TIP. The name of petitioner figured in this case on the basis of confessional statement of co-accused namely Md. Dulare who has already been granted bail vide Cr. Misc. No. 80847 of 2023. It is also submitted that petitioner is in judicial custody since 19.11.2024 having six criminal antecedent. He further submits that other co-accused has been granted bail vide Cr. Misc. No.80847 of 2023, 7107 of 2024, 75318 of 2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR, impugned order dated 11.02.2025, it appears that petitioner's name has been figured from the confessional statement of the co-accused namely Md. Dulare who has already been granted bail by this Court vide Cr. Misc. No. 80847 of 2023 and also considering the fact that other accused person has already been granted bail by the co-ordinate Bench of this Court let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of
