JUSTICE MADHURESH PRASAD ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is an accused in a case registered for offence under section 379 IPC. Allegation is that the petitioner's SIM was being used in the stolen mobile phone of the informant. Counsel for the petitioner submits that there is no recovery from the petitioner. Prior to the lodging of this case, he is accused in other cases mentioned in paragraph 3 of the bail application, in which he is already on bail. Petitioner is in jail custody since 27.7.2013.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Anwar Samim, Additional Chief Judicial Magistrate, Railway, Begusarai on the following conditions :- (a) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner.
