JUSTICE ALOK KUMAR PANDEY ORAL ORDER 07-06-2022 Let the defect(s), as pointed out by the office, be removed within a period of four weeks from today. Heard learned counsel for the petitioners and learned APP for the state.

The petitioners seek regular bail in connection with Sadar P.S. Case No. 590 of 2021, registered for the offences punishable under Section 379 of the Indian Penal Code and later on Section 411 of the Indian Penal Code.

As per seizure list, it is alleged that both the petitioners were using the alleged motorcyle and they were apprehended.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.19743 of 2022(2) dt.07-06-2022 2/2 petitioners bears no criminal antecedent and the petitioners are in custody since 08.11.2021. The name of the present petitioner transpires on the confessional statement of petitioner no. 1. The learned APP for the State vehemently opposes the prayer for bail of the petitioners.

Considering the facts and circumstances of the case as well as period of custody and also taking into consideration the material available on record, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court of C.J.M., Purnea in connection with Sadar P.S. Case No. 590 of 2021, Subject to following condition:- (i) One of the surety shall be either father or mother or sister or brother or wife or the person who sworn the affidavit in bail application.

(ii) Petitioner shall co-operate in trial and will remain present on all dates and absence for two consecutive dates would be a ground for cancellation of bail by the learned trial court itself.
