Petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 498 (A)/ 34 of the Indian Penal Code.
On instruction, it is submitted that the petitioner is ready to keep the informant as wife with full dignity and honour but the informant is not willing to live with the petitioner as stated in para-14 of the petition, which read as follows:- "That the petitioner is always ready and willing to keep the informant with full dignity and honour as wife but the informant who did not want to live with him. She is only interested in is earning and have greedy eye upon
Patna High Court Cr.Misc. No.38851 of 2014 (2) dt.10-02-2015 2/2 his property. The informant not even allowed the petitioner to meet with his daughter."
Both sides agree to appear before the learned court below on 23rd April, 2015 when the petitioner will take the informant to keep her as wife with full dignity and honour. Considering the present stand of the petitioner, let the above named petitioner be released on provisional anticipatory bail for one year in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Rasulpur P.S.Case No. 69 of 2013 on furnishing bail bonds of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. The provisional bail of the petitioner will be confirmed by the learned court below in three eventualities (i) if the matrimonial harmony is substantially restored or (ii) if the informant gets reluctant to resolve the issue or (iii) if the informant fails to appear before the learned Court below.
