JUSTICE MADHURESH PRASAD ORAL ORDER 10-01-2018 Heard counsel for the petitioner, APP and the informant. This is a case registered under Sections 304B, 201/34 of Indian Penal Code.

Counsel for the petitioner submits that the petitioner is merely co-villager and Gotia of the husband of the deceased and vague and omnibus allegation has been levelled against him. Further, the information regarding death had been communicated to the parents of deceased who had also reached during funeral. Charge sheet has already been submitted and the petitioner having no antecedent is in jail custody since 10.8.2017.

In the facts and circumstances of the case as also in view of the custody of the petitioner, his prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Sherghati, District Gaya in Gurua case no. 66 of 2017 on the following conditions :- (a) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how

(b) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
