Heard Mr. Y.C. Verma, learned Senior Counsel assisted by Mr. Dilip Kumar for the petitioners, learned APP for the State as well as learned counsel appearing on behalf of the informant.

The petitioners apprehend their arrest in connection with Bypass P.S. Case No.491 of 2021, registered for the offences punishable under Sections 420, 406, 385, 384, 471, 427, 506, 467, 468 and 34 of the Indian Penal Code. The petitioners and other co-accused persons are said

Patna High Court CR. MISC. No.19372 of 2022(3) dt.05-09-2022 2/3 to have taken extortion money of Rs.25,00,000/- in the name of giving possession of land to the informant. It is also alleged that the accused persons are still demanding Rs.50,00,000/- as an extortion money.

Learned Senior Counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is further submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is submitted that there is general and omnibus allegation against the petitioners and the petitioners never demanded extortion money from the informant.

Learned counsel for the informant opposed the prayer for anticipatory bail of the petitioners and submitted that the petitioners executed the sale deed in pursuance to agreement dated 07.11.2015 in favour of different persons on 27.04.2017 and in four sale deeds informant was a witness and in two sale deeds Atanu Saha was the witness.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds
