The petitioner is seeking regular bail in Jamui P.S. Case No. 321 of 2017 registered under Sections 147, 149, 337, 338, 307, 295, 332, 120(B), 353, 188/153(A)(b)(c) and 173 of the Indian Penal Code.
It is submitted that the petitioner is one of the several accused named in the F.I.R. The allegation against the petitioner is that he was a member of the mob and was involved in pelting stones when the members of other community were enjoying their festival. Learned counsel submits that there is no specific allegation against this petitioner and his name has been mentioned only because he is a resident of the colony where this occurrence took place. Patna High Court Cr.Misc. No.195 of 2018 (2) dt.12-01-2018 2/2 similarly situated have been granted regular bail by a co-ordinate bench of this Court.
Considering the facts and circumstances of the case, let the petitioner, named above, be released on bail on his furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 321 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
