JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-08-2015 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 323, 324, 341, 34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case as per written report submitted by the brother of the victim Rohit Kumar is that the F.I.R. named accused persons resorted to fire when from the place of occurrence one towel, one live cartridge and one used cartridge were recovered. During course of the investigation, on the application of the wife of the F.I.R named accused the petitioner has been tried to be roped in by the police maliciously.
This Court is reluctant to interfere due to the serious criminal antecedent of the petitioner, but keeping in view the nature of accusation, it is a case for consideration of
Patna High Court Cr.Misc. No.32180 of 2015 (2) dt.07-08-2015 2/2 regular bail, if the petitioner surrenders within a period of six weeks in connection with Naokothi P.S. Case No. 83 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Begusarai.
Accordingly the application is disposed off.
