JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased, who died in other than normal circumstances within one year of her marriage. There is allegation that petitioner and his other family members used to torture the deceased due to non fulfillment of illegal demand. Furthermore, the first information report goes to show that petitioner gave information to the informant in respect of death of the deceased but before arrival of the informant, petitioner and others disposed of dead body of the deceased so that informant could not get any evidence of unnatural death of the deceased.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.25558 of 2016 (2) dt.21-06-2016 2/2 well as submissions of the parties, I am not inclined to grant privilege of bail to the petitioner and, hence, his prayer for bail in connection with Chandauti P.S.Case No. 270 of 2015, pending in the court of Learned Chief Judicial Magistrate, Gaya, stands rejected.
