The petitioners, who are in custody, seek bail in connection with Jai Nagar P.S. Case No. 178 of 2016 registered for the offence punishable under Sections 364, 34 of the Indian Penal Code.
Informant is the father of Satyendra Paswan who is missing since 09.04.2016 and it has been stated that he had lodged a Sanha regarding of his missing son but even after four months he has not returned, as such he is lodging the present FIR after four months of the occurrence. In the FIR the general statement has been made that the Rohan Paswan and Lukesh Paswan has taken his son with him and thereafter he has not
Patna High Court Cr.Misc. No.2914 of 2018(3) dt.09-02-2018 2/2 returned, there is no explanation for delay of four months for lodging the FIR. They are residents of same locality and there is one criminal case registered against petitioner No. 1 Rohan Paswan, however there is no antecedent of petitioner No. 2 and petitioner No. 1 is in custody since 02.05.2017 and petitioner No. 2 is in custody since 19.04.2017. Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Madhubani, in connection with Jai Nagar P.S.
