The petitioner is in custody in connection with Rani Talab P.S. Case No. 93 of 2017, a case under Sections 364, 365/34 of the Indian Penal Code.
The son of the informant had gone to the market, thereafter, he did not return. Due to land dispute, the petitioner and others are under suspicion, to have kidnapped the boy with intent to commit his murder. On recovery, statement of the victim was recorded under Section 164 Cr.P.C. wherein, he has levelled allegation against the petitioner and others of kidnapping. Submission is that petitioner has been falsely implicated in this case due to land dispute. He further submits that the police did not send up the accused persons for trial. However, the learned court below took cognizance. Even if, the allegation is assumed to be correct, a simple case of kidnapping is made out. Petitioner is in custody since 04.08.2017.
Learned counsel for the informant opposes the prayer for bail.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Rani Talab Police Station Case No. 93 of 2017 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
