The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in a case registered under Sections 302/201/120B of the Indian Penal Code.

The prosecution case in brief is that the husband of the informant went to the village from her Maike with the accused persons for taking away the money of Indira Awas but he did not return and later on, the dead body of informant's husband was found burried in Chamainiya Dah River.

Patna High Court CR. MISC. No.16832 of 2020(2) dt.02-06-2020 2/2 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 28-08-2019. Charge sheet has already been submitted. It is a case of last seen. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case and also the lockdown, the petitioners, above named, are directed to be released on bail on their personal bond to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Nawada in connection with Kauwakole P.S. Case No. 259 of 2019. Once the normalcy is restored, the petitioners shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of four weeks to the satisfaction of the court concerned in connection with the aforesaid case.
