11-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Palasi P.S. Case No. 265/2017 registered for the offence punishable under Sections 379/411 of the Indian Penal Code.

Learned counsel for the petitioner submits that according to the informant a motorcycle went stolen on 30.09.2017 and he found this petitioner along with motorcycle on 06.10.2017 and got him apprehended. Submission is that for six days no F.I.R. was lodged by the informant complaining theft of his motorcycle, therefore, the whole story of theft has been

Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - VI, Araria in connection with Palasi P.S. Case No. 265/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
