Case No. 235 of 2017 dated 26.12.2017, instituted for the offences under Sections 272, 273, 308 of the Indian Penal Code and Sections 30/38 of the Bihar Prohibition & Excise Act, 2016. The learned counsel for the petitioners has submitted that the petitioners have been named by the villagers alleging that they had run away from the place where local liquor was being manufactured. It has not

Patna High Court Cr.Misc. No.54558 of 2018(2) dt.04-09-2018 2/2 been stated in the F.I.R as to which villagers named the petitioners. It has, therefore been submitted that the implication of the petitioners is only on the basis of some stray disclosure made by the villagers.

The petitioners are in custody since 03.07.2018 and they were made accused in one other case of similar nature apart from the present case.

Regard being had to the period of custody of the petitioners above named, they are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Raghunathpur P.S. Case No. 235 of 2017.
