JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. 96 bottles of country made liquor were recovered from the house of the petitioner.
Although learned counsel for the petitioner submits that nothing was recovered from the house of the petitioner and petitioner is in jail custody since 10.04.2016 without having any criminal antecedent but taking into consideration that the alleged recovery was made after amendment of the provisions of Excise Act, I am not inclined to grant privilege of bail to the petitioner and, hence, his prayer for bail in connection with Warsaliganj P.S.Case No. 68 of 2016, pending in the court of Sub-Divisional Judicial Magistrate, Nawada stands rejected.
