Patna High Court Cr.Misc. No.28846 of 2016 (3) dt.31-08-2016 2/3 31-08-2016 Since all three applications arise out of Neema Chandpur P.S. Case no. 71 of 2015, they have been heard together and are being disposed of by this common order.
The petitioners seek bail in the aforementioned case instituted under Sections 147, 148, 149, 307, 302, 323, 353, 333, 224 and 225 of the Indian Penal Code, 27 of the Arms Act and 18/20 of the U.A.P.A. Act.
Allegation is that Amit Kumar, SH.O.
of Neemachandpur Police Station along with police force went to investigate and came to know the presence of veteran criminal Bino Sada at certain place and proceeded towards that place. Bino Sada was arrested and on his raising alarm the persons present there started brick-batting to get Bino Sada free from the clutch of police. In course of brick-batting informant received injury and one constable died.
It has been submitted on behalf of the petitioners that they are in custody since 28.10.2015. Chargesheet has been submitted against the petitioners. Petitioners do not have any criminal antecedent. There is no allegation of tampering of witnesses against the petitioners. No specific overt act has been alleged against the petitioners. No specific injury has been attributed against the petitioners.
On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Begusarai, in connection with Neema
