JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 12.05.2016 in a case registered for the offences punishable under Sections 498A, 323, 420/34 and 376/354 of the Indian Penal Code, Section 3/4 of the Dowry Prohibition Act and Section 3 (I) (X)(XII) of the SC/ST (Prevention of Atrocities) Act.
The prosecution case is that co-accused Ranveer Yadav concealing his caste performed marriage with the informant nine months prior to the lodging of the case. The petitioner alleged to have felicitated the marriage. Ranveer Yadav established physical relationship with the informant but when the informant went to Ranveer Yadav's village then he refused to recognize her and then
Patna High Court Cr.Misc. No.25926 of 2016 (2) dt.23-06-2016 2/2 the petitioner made assault to the informant. It is submitted by learned counsel for the petitioner that thrust of accusation is against co-accused Ranveer. The petitioner has been roped in the present case since he happens to be covillager and friendly to Ranveer Yadav. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Mahila Thana (Saharsa) P.S. Case No. 74 of 2015.
