The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 323 and 341 of the Indian Penal Code.
Allegedly, it is a case of committing rape of the complainant/victim by this petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that earlier the victim filed a criminal case against this petitioner, in which the police has not sent up the petitioner for trial.
Learned APP appearing for the State has opposed the
Patna High Court CR. MISC. No.18661 of 2022(3) dt.16-11-2022 2/2 prayer for anticipatory bail and submitted that the victim has supported the prosecution case in her statement recorded under Section 202 of the Cr.P.C. .
After considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.
