The petitioner, in the present case, is seeking regular bail in connection with Marhaura P.S. Case No 243 of 0217 registered for offences alleged under Sections 302, 307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that she has caught hold of her father and assisted her brother thereby in giving assault on the neck of his father, causing sever injuries on the neck, which ultimately proved fatal and his/her father died. He submits that in this case, the informant is the mother of this petitioner, who has seen the alleged

Patna High Court Cr.Misc. No.124 of 2018 (2) dt.11-01-2018 2/2 occurrence and have lodged the F.I.R. specifically attributing the overt act committed by her son and the active role which has been played by this petitioner in assisting her brother to commit assault on the father.

Learned APP opposed the prayer for bail.

Considering the facts and circumstances of the case and the allegations which are serious in nature and since the FIR has been lodged by the mother of the petitioner, which is required to be considered with some seriousness, this Court is not inclined to grant regular bail to the petitioner in connection with Marhaura P.S. Case No. 243 of 2017 pending before learned Judicial Magistrate, Saran at Chapra.

The application is dismissed accordingly.
