2. The petitioner has preferred this application for grant of regular bail in connection with Alamganj Case No. 332 of 2024 dated 21.04.2024 registered for the offences punishable u/s 307, 302 read with Section 34 of the IPC and section 27 of the Arms Act.

3. As per the prosecution case, the petitioner along with the other co-accused persons assaulted the son of the informant Atul Kumar and Aman Kumar with fists and the coaccused Munna Yadav @ Munna Chhit and Daddu fired from pistol on Atul Kumar due to which he received injury in stomach and left hand and later on he died during the course of treatment.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to suspicion. He further submits that the informant is not an eye-witness. There is no specific allegation against the petitioner. The alleged occurrence took place on 30.10.2023 but FIR was lodged against the petitioner on 21.04.2024 i.e. after delay of six months. The petitioner has one criminal antecedent in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 26.10.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned/ A.C.J.M. IV, Patna City in connection with Alamganj P.S. Case No. 332 of 2024.

7. The application stands allowed.
