JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2016 Petitioner is languishing in custody since 10.05.2016 in a case registered for the offences punishable under Sections 20(1)(C)/22, 27 of the N.D.P.S. Act. The prosecution case is that on information that several persons are indulged in selling of ganja, raid was led when ten persons were apprehended. From the possession of the petitioner 105 sachets of ganja each containing 4 gms total weighing 420 grms were recovered along with cash of Rs. 1000/- It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case. The quantity of recovery is small and a statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Mrs. Sharda Kumari, learned counsel for the

Patna High Court Cr.Misc. No.25867 of 2016 (2) dt.23-06-2016 2/2 State does not controvert the small quantity of recovery from the petitioner.

Considering the quantity of recovery coupled with statement in para 3 of the petition that petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II, Patna in connection with Rajiv Nagar P.S.
