JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 13.4.2017 passed in Cr.Misc.No. 17136 of 2017 with a direction to the trial court to expedite the trial.

Submission of learned counsel for the petitioner is that no substantial progress has been made in the trial and petitioner is languishing in jail custody for more than one year. Heard learned APP also.

On perusal of the report submitted by the trial court it appears that charge has been framed in this case and summons have been issued for appearance of the witnesses. In such view of the matter, I am not inclined to grant bail to the petitioner.

No.63511 of 2017 (3) dt.24-01-2018 2/2 However, as charge has already been framed, learned trial court is directed to expedite the trial and try to conclude it within a period of seven months by conducting it on day to day basis. At the same time, Superintendent of Police, Muzaffarpur is directed to ensure the presence of the witnesses in court on the date fixed.
