JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 06-04-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner has renewed his prayer for bail in a case registered for the offence punishable under Sections 302, 307, 120B/34 of the Indian Penal Code.

In pursuance to the order dated 26.02.2021, report, regarding present stage of trial of the present case, has been transmitted by the learned Court below, which is kept at Flag 'A', which suggests that one of the accused namely Bablu Tatwa has been shifted to Buxar Central Jail and the other accused Omkar Nath Singh @ Sheru Singh has been shifted to Bhagalpur Central Jail. Both the accused persons were not being produced physically, though they were produced before the learned trial court through virtual mode on 06.03.2021. The report further suggests that an application has also been filed on

Patna High Court CR. MISC. No.19487 of 2020(4) dt.06-04-2021 2/2 behalf of one of the accused Omkar Nath Singh @ Sheru Singh that he has got serious objection with regard to examination of evidences/witnesses through virtual mode and he wants to get the evidences/witnesses examined physically.

Considering the report of the trial court, the trial court is directed to conclude the trial within one year. At the same time, the S.P., Ara is also directed to ensure the presence of witnesses in the court, so that the trial may be concluded within time limit given by this court. The concerned S.P. is also directed to produce the accused person as and when required by the trial court through virtual mode/Video conferencing. Accordingly, this application is dismissed.
