JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-06-2020 Heard Mr. Vikramdeo Singh, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Kurhni P.S. Case No. 842 of 2019, dated 25.12.2019, instituted for the offences under Sections 341, 323, 324, 307 and 302/34 of the Indian Penal Code.

The petitioner is the wife of the deceased, who is alleged to have killed her husband. The F.I.R. has

Patna High Court CR. MISC. No.16693 of 2020(2) dt.03-06-2020 2/3 been registered by the mother of the deceased, who claims to have seen the occurrence. It appears that the petitioner and her son killed the deceased.

It has been urged on behalf of the petitioner that the deceased was a drunkard who had fallen on the ground in a state of stupor, leading to grievous injuries on him on his person and he ultimately succumbed to those injuries. The instant case appears to have been lodged by the mother of the deceased for some ulterior purposes; perhaps for appropriating the share of the deceased in the family property.

The petitioner is stated to be in custody since 26.12.2019.

Considering the period of custody of the petitioner and the possibility of false implication, she is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, West Muzaffarpur in connection with
