The petitioners are apprehending their arrest in a case registered for the offence punishable under sections 323, 341, 504/34 of the Indian Penal Code and section 3(1)(x) of the SC/ST Act.

Prosecution case is that in the background of dispute with regard to earth filling work and repairing of road, petitioner no.1 Ramchandra Mahto has tried to push the informant, as a result of which he fell down. Thereafter the other accused persons abused him by calling the caste name. On protest being made, they snatched Rs.1000/-.

It is submitted by the learned counsel for the petitioners that for the dispute with regard to filling up of the road some

Patna High Court Cr.Misc. No.25415 of 2016 (2) dt.23-06-2016 altercation took place. Though there is allegation of snatching Rs.1000/- from the possession of the informant, but the same has been found to be false. Statement has been made in paragraph 3 of the application that the petitioners have no criminal antecedent. Considering the aforesaid facts, it is a fit case for consideration of regular bail to the petitioners. Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Sheikhpura SC/ST P.S.Case No. 28/2015 pending in the court of Chief Judicial Magistrate, Sheikhpura. With the aforesaid observation, this application is disposed of.
