The Petitioner seeks regular bail in connection with Katoria, P.S. Case No. 52 of 2018, registered for offences punishable under Sections 302, 201/34 of I.P.C. Allegation against the petitioner as per F.I.R. is that the dead body of the brother of the informant, who was generator Mistry, was found lying near Railway line and later on the name of the petitioner transpires during course of investigation. Submission of the learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and no direct evidence is available against the petitioner and the petitioner has no criminal antecedent and he is in custody since 21.07.2018 and
Patna High Court Cr.Misc. No.64811 of 2018 (2) dt.29-10-2018 2/2 charge sheet has already been submitted against the petitioner. Heard learned A.P.P who opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Banka, in connection with Katoria, P.S. Case No. 52 of 2018, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
