JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-09-2022 The present writ petition has been filed seeking the following relief:- "i) That, this is an application for the grant of appropriate writ, directing the respondents to free the encroached land bearing plot no. 75/43, khata no. 282/34, area 0-43 and plot no. 86/43, area 112 decimal, Mauza Babura, Thana No. 226, P.S. Dhankund, District Banka, which is a public land as defined in Sub-section XV of 1956, which immediate effect and allow the present application with cost and cost of litigation"

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle

Patna High Court CWJC No.9119 of 2021(2) dt.23-09-2022 2/2 Officer, Dhoraiya, District Banka for redressal of his aforesaid grievances. Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Dhoraiya, District Banka, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of 4 weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
