JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47 of the Excise Act.
Taking into consideration that ten litres country made liquor were recovered from the house of the petitioner, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Korha P.S. Case No. 74 of 2016 pending in the court of Chief Judicial Magistrate, Katihar stands rejected.
