This is an application for regular bail in connection with Bangaon P. S. Case No. 32 of 2017 registered for the offences punishable under Sections 148, 148, 149, 307, 399, 402, 353, 332, 333, 188, 224, 225 of the Indian Penal Code and 25(1-b)a, 25(1-AA), 26, 27 and 35 of the Arms Act.
Informant, who is a police inspector, has alleged that on receiving information that one of the accused persons of Saharsa P. S. Case no. 256 of 2017 was hiding in the house of the petitioner, he surrounded and raided it upon which the accused persons started firing upon the police and in retaliation police also fired in which one of the accused Amit Jha was killed. Patna High Court Cr.Misc. No.58701 of 2017(3) dt.12-01-2018 2/2 petitioner is that he is owner of the house and one carbine was seized from his house. It is further submitted that six accused pesons out of seven, have already been granted bail by the High Court.
Considering the facts and circumstances of the case and petitioner is in jail custody since 15.04.2017, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bangaon P. S. Case No. 32 of 2017.
