JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 47(a)(g) and 57(1) of Bihar Excise Amendment Act.

A huge quantity of Indian made foreign liquor was recovered from the house of the petitioner. No doubt, possession of Indian made foreign liquor does not constitute an offence but recovery of huge quantity of Indian made foreign liquor goes to show that petitioner was engaged in trade.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to
