JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Excise Act. First information report discloses that two litres country made liquor kept in a bottle was recovered from conscious possession of the petitioner but seizure list goes to show that four litres country made liquor kept in two separate bottles were recovered from conscious possession of the petitioner. Submission on behalf of the petitioner is that the aforesaid contradiction goes to show the false implication of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-9, Saran at Chhapra in connection with Taraiya P.S.
