This is 2nd attempt for grant of bail on behalf of petitioner. Earlier, the prayer for bail of petitioner was rejected, vide order dated 20-09-2019 passed in Cr.Misc. No. 40399 of 2019 (Annexure - 1 to the bail petition).

In this regard, vide order dated 16-10-2020, a report was called for from the Trial Court regarding stage of the trial, which has been received and kept at flag 'A'. From perusal of report of learned Trial Court, as contained in Letter No. 199 dated 13-11-2020, it appears that presently case is awaiting for submission of chargesheet against rest accused persons including petitioner, against whom, investigation is going on.

Patna High Court CR. MISC. No.20572 of 2020(3) dt.05-12-2020 2/2 It is submitted by learned counsel for the petitioner that petitioner is in custody since 25-03-2019 and no adequate progress has taken place in the trial.

Considering the aforesaid facts and circumstances as well as considering the fact that no adequate progress has taken place in the trial, as per report of the trial court, the bail application of petitioner is allowed. Let the above-named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, District - Gaya in connection with Roshanganj P.S. Case No. 59 of 2011, on following conditions:-

1. One of the bailors will be the close relative of the petitioner,

2. The petitioner will not indulge in similar or in any other offence,

3. The petitioner will be well represented in the court, and

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
